Are Warrants Public Information in Michigan?

Arrest warrants and bench warrants become part of the court case file once issued, and Michigan court records are presumptively open to the public. The state's Freedom of Information Act, MCL 15.231 et seq., requires public bodies to respond to records requests within five business days and grants access to government records unless a specific exemption applies.

The exemption most relevant to warrant records is MCL 15.243(1)(b), which allows law enforcement agencies to withhold "investigating records compiled for law enforcement purposes" when disclosure would interfere with proceedings, deprive someone of a fair trial, or endanger officer safety. Active, unserved arrest warrants regularly fall under this exemption — agencies are not compelled to confirm an outstanding warrant if doing so would compromise the investigation or alert the subject. Once served, the warrant and its associated charging documents become part of the open court record.

Search warrant affidavits follow a distinct and unusually specific timeline in Michigan. Under MCL 780.651(8)–(9), a search warrant affidavit is classified as nonpublic information from the moment it is filed. On the 56th day after issuance, the affidavit automatically becomes public — unless a prosecutor or peace officer obtains a suppression order before that deadline. Each suppression order lasts 56 days, and subsequent extensions can be obtained with a showing that suppression remains necessary.   3. Contact the county sheriff's office or district court clerk. Have the subject's full legal name, date of birth, and, if known, the county where charges may have originated. How Long Is a Warrant Active in Michigan?
