    Are Warrants Public Information in Michigan?

    Arrest warrants and bench warrants become part of the court case file once issued, and Michigan court records are presumptively open to the public. The state's Freedom of Information Act, MCL 15.231 et seq., requires public bodies to respond to records requests within five business days and grants access to government records unless a specific exemption applies.

    The exemption most relevant to warrant records is MCL 15.243(1)(b), which allows law enforcement agencies to withhold "investigating records compiled for law enforcement purposes" when disclosure would interfere with proceedings, deprive someone of a fair trial, or endanger officer safety. Active, unserved arrest warrants regularly fall under this exemption — agencies are not compelled to confirm an outstanding warrant if doing so would compromise the investigation or alert the subject.
